Terms and Conditions of the “Mutual Benefits” Promotional Program at

§1. Definitions of terms used in these Rules:

1.1. Organizer – Pruszyński Company, with its registered office in Sokołów, at ul. Sokołowska 32B, 05-806 Komorów, entered in the Register of Entrepreneurs at the District Court for the Capital City of Warsaw, 14th Commercial Division of the National Court Register, under number 0000054020; Tax ID (NIP) 534-21-39-235; National Business Registry Number (REGON) 016480890, with share capital of 17,688,200 PLN

1.2. Program – “Mutual Benefits” Promotional Program

1.3. Online Ordering System – https://zamowienia.pruszynski.com.pl/, Blachy Pruszyński Company’s online platform for placing orders for Promoted Products

1.4. Partner Company – a business entity with its registered office in the Republic of Poland, holding a NIP, that makes purchases through the Online Procurement System. If you are not registered in the Online Ordering System, please contact the Organizer to obtain the login credentials.

1.5. Sales Representative – an employee of a Partner Company who orders Promoted Products through the Online Ordering System

1.6. Roofing contractor – a roofing company or a self-employed professional operating in the Republic of Poland who purchases Promoted Products or facilitates their purchase.

1.7. Featured Products – products from the Blachy Pruszyński Company’s product lineup sold through the Online Ordering System.

1.8. Premium Featured Products – products from the Blachy Pruszyński Company’s product lineup selected by the Organizer in a separate notice.

1.9. Prize Catalog – a collection of items prepared by the Organizer. Any Participant may purchase these prizes in accordance with the terms set forth in §5 of these Rules and Regulations.

1.10. Terms and Conditions – the terms and conditions of this Promotional Program, which constitute a public promise by the Organizer that may be revoked.

1.11. Program Participant – a Partner Company, Roofer, or Sales Representative who has joined the “Mutual Benefits” Promotional Program in accordance with the provisions of these Terms and Conditions.

1.12. Participant Account – Program Participants will have an individual username and password that will allow them to log in to their personal account, where they can place orders through the Online Ordering System (applies to Partner Companies and Sales Representatives) as well as check their point balance and order items from the Rewards Catalog (applies to Partner Companies, Sales Representatives, and Roofers).

§2. General Provisions:

2.1. The organizer of the “Mutual Benefits” Promotional Program is Pruszyński Company, with its registered office in Sokołów, at 32 Sokołowska Street, 05-806 Komorów.

2.2. The program is organized within the territory of the Republic of Poland.

2.3. The purpose of the Program is to promote the Blachy Pruszyński Company brand and the products offered by the Organizer.

2.4. Participation in the Program is voluntary and free of charge.

2.5. The program is intended for companies that place orders for the Organizer’s products through the Online Ordering System, as well as for sales representatives and roofers involved in placing those orders.

2.6. The Program begins on May 6, 2019, and continues until further notice. The Organizer agrees to notify Participants of the Program’s termination thirty days in advance.

2.7. The “Mutual Benefits” Program is not a continuation of the 5th Edition of the Promotional Program.

§3 Enrollment in the Program

3.1. Partner Company

3.1.1. To join the Program, a Partner Company should log in to the Online Ordering System, and then, when a window appears with information about the launch of the “Mutual Benefits” Promotional Program “Shared Benefits,” accept the Program Terms and Conditions and the Privacy Policy. These acceptances are equivalent to joining the Program and consenting to receive invoices for the selected Promotional Items/Rewards. Invoices for Promotional Items/Rewards will be provided in the same format as invoices for ordered goods.

3.1.2. A Partner Company may have only one Account (only one Account may be assigned to a single NIP number)

3.2. Salesperson

3.2.1. After joining the Program, each Partner Company has the option to register it in the Promotional Program.

3.2.2. To register a salesperson, the Partner Company should log in to its User Account and click the “Add Salesperson” tab. This will bring up the salesperson registration form, which includes the following information that must be filled out and submitted:

Company Name
Residential Address
PESEL (required to issue PIT information)
The tax office with jurisdiction over the place of residence
Phone number
Email address

3.2.3. Once successfully registered, the Trader will receive an SMS message confirming their registration in the Program, along with a unique username and password, which they will use to log in to their Program Account

3.2.4. You must log in to the above-mentioned Account for the first time—and thereby accept the Terms and Conditions and Privacy Policy—in order to activate it and begin earning points. After accumulating the required number of points, the Merchant is entitled to order a selected Promotional Item or Reward from the Rewards Catalog.

3.2.5. Income from receiving the Prize, earned by a Participant who is a consumer (Retailer), is combined with other income earned by the Participant during the given tax year. Such a Participant is required to file a tax return with the appropriate tax office. For the ordered Promotional Items and Prizes, the Merchant will receive from the Organizer, within the timeframe prescribed by generally applicable laws, a PIT form enabling the Merchant to file the appropriate tax returns. To this end, the Salesperson is required to provide (and update) their information necessary for preparing the PIT information.

In order to receive the selected Prizes, you must complete and submit to the Organizer the information needed to file the appropriate PIT return.

3.2.6. A salesperson may have only one account in the Program (only one account may be assigned to a single name)

3.3. By Collecting Points for Yourself – You Also Collect for Your Company!

3.3.1. A roofer can join the Program during a visit to any Partner Company that places orders through the Online Ordering System. The owner of a Partner Company or a sales representative can register the roofer. Information required for registration:

3.3.2. After registering, the roofer will receive a username and password for their personal Participant Account via the phone number provided.

3.3.3. You must log in to your Participant Account yourself—which constitutes acceptance of the Terms and Conditions and Privacy Policy—in order to activate it and begin earning points. The login link will be available on the Organizer’s homepage at www.pruszynski.com.pl

3.3.4. Once the Roofer has accumulated the required number of points, he or she becomes eligible to claim a selected Reward. At the same time, the Roofer is responsible for assessing the tax implications of the Rewards received (there may be an obligation to recognize income from business operations).

3.3.5. A roofer may have only one account in the Program (only one account may be assigned to a single NIP number)

3.3.6. The organizer reserves the right to contact you by phone to verify the information provided on the registration form.

§4 Recording Transactions

4.1. After registering and logging in to the Program, the Partner Company or Sales Representative enters orders into the Online Ordering System. On the order form, they have the option to include the username of the Roofer who helped place the order. In this way, Points will be awarded to the Partner Company, the Sales Representative, and the Roofer in accordance with the rules set forth in §5.

4.2. Points are credited to Participants’ accounts after an Organizer employee approves the order. If items are removed from an order, exchanged for packages (which are not promotional products), or if the entire order is canceled, the points for that order will be deducted from the Participants’ accounts.

§5 Rules for Calculating Points

5.1. For orders placed and approved for Promoted Products, points are awarded according to the following rule:

Each full 100 PLN net = 10 points

These points are then divided between participants in the proportions:

3 points for Partner Company, 3 points for Salesperson, 4 points for Roofer

5.2. Points are collected on 3 independent participants’ accounts and, in principle, do not add up. This means that if a cooperating company does not register a salesman, it only receives the points due to their own, the points due to the trader are lost. The same rule applies to the lack of consideration in the order of the Dekarz login – the points belonging to him are lost.

5.3. At any time during the Program, a Participant may be awarded additional points based on other promotional activities undertaken by the Organizer that are not related to the Program (i.e., governed by separate terms and conditions). In such a case, the Program Participant is required to complete other activities aimed at earning additional points. The Organizer will notify interested parties of the opportunity to earn additional points in separate announcements, in a manner it deems appropriate. Participants shall have no claims arising therefrom.

§6 Placing Orders

6.1. After registering and logging in to the Program, the Sales Representative enters orders into the Online Ordering System. The order form allows you to enter the username or tax ID (NIP) of the roofer who helped place the order. In this way, once the order is approved by an employee of the Organizer, points will be awarded to the Partner Company, the Sales Representative, and the Roofer in accordance with the rules set forth in §5.

6.2. If the Roofer’s login is not provided, points will be awarded only to the Partner Company and the Sales Representative, but in an amount not exceeding that specified in §5, point 5.1.

§7 Promotional Items Catalog and Purchase Policies

7.1. In exchange for the points earned (in accordance with the rules set forth in §5), a Partner Company participating in the Program acquires the right to purchase Rewards prepared by the Organizer at preferential prices, i.e., with a 99% discount on their value. In the case of Roofers and Sales Representatives, they acquire the right to redeem Rewards from the Rewards Catalog solely with points, in accordance with the provisions of §3, point. 3.2.5.

7.2. The right to purchase Rewards arises no earlier than when the Participant has earned a number of points greater than or equal to the number of points required for the Rewards selected by the Participant.

7.3. Each Participant can check their point balance by logging into their Program Account.

7.4. In exceptional circumstances, the Organizer reserves the right to make changes to the Promotional Items Catalog—these include:

a) changes in the price of an item—resulting from changes in the market prices of the Prizes

b) withdrawal of the Prize due to unavailability from suppliers

c) changes to the color scheme—due to the unavailability of the current color from suppliers

7.5. Ordered prizes cannot be returned or exchanged. The exception is the complaint procedure described in §8, which applies when a damaged item is delivered or an item that does not match the order is delivered.

7.6. To order Rewards, the Participant logs into their Account and places an online order for the selected items in the “Rewards” tab. The Participant may submit orders for Rewards during the Program and within 30 days of the date of its termination. After this period expires, unused points will be canceled and cannot be exchanged for any equivalent.

7.7. After selecting the Reward in the order summary, choose one of the available delivery methods:

a) by courier to the specified address – in the Rewards Catalog, you can select courier delivery for a specific number of points (Roofing Contractor, Partner Company, Sales Representative)

b) along with orders placed with a Partner Company (only a Partner Company has this option)

7.8. If the supply of a particular Prize selected by the Participant in accordance with the provisions of these rules runs out, or if any of the ordered Prizes is replaced with another item, the Participant will be notified of this fact in writing via email to the email address provided in the application, by phone, or via text message to the cell phone number provided in the application. In such a case, the Participant may order another item from the Prize Catalog in accordance with the rules set forth in these Terms and Conditions

7.9. For Rewards ordered by a Partner Company, an invoice will be issued at the discounted prices listed in the Rewards Catalog at www.pruszynski.com.pl, specifying the payment due date. The invoice will be issued in exchange for the use of points accumulated by the Partner Company in the Program.

In the case of a Merchant, due to the absence of business activity, a corresponding PIT form will be issued in connection with the use of points accumulated in the Merchant’s account. The current value of the Rewards is listed in the description of each item after logging in to the website zamówienia.pruszynski.com.pl/konkurs.php

The roofer also redeems Rewards solely with the points he has earned—at the same time, he independently assesses the tax implications of the Rewards he receives (he may be required to report income from his business activities).

§8 Complaint Procedure

8.1. Complaints regarding participation may be filed throughout the duration of the “Mutual Benefits” Promotional Program and up to 30 days after its conclusion. However, complaints regarding promotional items must be submitted no later than 7 days from the date of receipt of the item to the following email address: wk.reklamacja@pruszynski.eu

8.2. The complaint must include the following information: the Participant’s first and last name, tax identification number (NIP) (for Roofers and Partner Companies), contact phone number, and the reason for the complaint along with a justification. If any of the above information is missing, the Organizer reserves the right not to process such a complaint.

The organizer undertakes to review the complaint and respond to it within 30 days of the date it is received

§9 Amendments to the Rules and Regulations

9.1. In exceptional circumstances, the Organizer reserves the right to make changes to these Terms and Conditions—these include:

a) changes to the ordering process directly related to the operation of the Online Ordering System, particularly its updates.

(b) any changes beyond the Organizer’s control that result from changes in tax law

However, these changes may not infringe upon the rights acquired by Program Participants, particularly the number of points they have already earned.

§10 Final Provisions

10.1. The organizer is not liable for the consequences of a Participant’s failure to complete the Registration Form correctly
